In the presented article, the author analyzes a socially dangerous act as part of abuse of office. The main attention is paid to the concept of «explicitness» of going beyond the limits of the granted powers. The author examines the forms of excess, and provides criticism of considering this composition as a general rule. The author proposes the application of the rules of the aggregate excess of official powers with other el ements of crimes only in the case of committing independent actions. In support of the presented conclusions, the author provides examples of judicial practice.
