The article deals with the problem of determining the status of the victim when qualifying a crime under Art. 143 of the Criminal Code of the Russian Federation. Based on the analysis of scientific literature, legal acts and judicial practice, the author identifies the causes and possible solutions to the problem of determining the labor legal status of the victim.
