The author considers the issues of qualification of illegal entry into a dwelling with the use of technical or other means, cites the forms proposed by the legal doctrine for the use of technical means when entering a dwelling. The article analyzes the novels of the Decree of the Plenum of the Supreme Court of the Russian Federation, which allowed such a possibility; possible cases of non-physical entry into a dwelling using technical means that can be qualified under Article 139 of the Criminal Code of the Russian Federation; problems of delimitation of the acts provided for by Articles 137 and 139 of the Criminal Code of the Russian Federation, among themselves, as well as with other elements of crimes (for example, in the field of computer information). The author comes to the conclusion that, under Article 139 of the Criminal Code of the Russian Federation, only physical penetration into a dwelling, committed both by the perpetrator himself and through the use of various technical means and devices, is subject to the qualification, non-physical penetration into a dwelling is qualified under other elements of crimes of the Russian criminal law.
