The article analyzes the provisions of the criminal procedure legislation providing for the duration of the application of detention after the referral of a criminal case to the court. Problems such as the lack of a maximum period of judicial detention for certain categories of crimes, the excessive duration of the initial application of the coercive mechanism, and the lack of a legitimate reason for extending further isolation when returning a criminal case to the prosecutor require further resolution at the regulatory level in order to form uniform judicial practice.
