ON THE QUESTION OF THE CONCEPT, HISTORICAL DEVELOPMENT AND FORMATION OF THE INSTITUTION OF INSIGNIFICANCE OF THE ACT IN CASES OF EMBEZZLEMENT

Abstract (English):
In the conducted scientific research, the authors explore the concept and historical development of the institution of insignificance during the Soviet period. Separate variants of the definition of this institution are considered from the point of view of the doctrinal approach, and its formation has been analyzed for a long time. In addition, to the term ‘insignificance’, the authors consider it appropriate and justified to use it in cases involving liability for violation of property. In conclusion, the authors believe that the institution of insignificance, despite the history of its development and formation, plays an important role in achieving a balance between criminal prosecution for theft of property and taking into account minor violations that do not require strict punishment. This study represents a significant contribution to the field of criminal law and may be useful for specialists involved in the consideration of cases of embezzlement. The authors substantiate the need for its adaptation to modern realities and social needs, in order to further ensure the fairness and effective functioning of the Russian legal system.
