Abstract (English):
In the study, the author points to the development of a cluster of digital objects recognized by Russian legislation. Digital objects are regulated not only in the codified civil law, but also in individual federal regulatory legal acts. The author notes that the semantic load of the term “crypto” in the Russian legal space characterizes the rights, assets and currency (code) issued in accordance with a foreign jurisdiction. Therefore, the circulation of cryptocurrency (crypto assets) is not regulated by the Russian legal system, which leads to certain problems in law enforcement practice in their protection. At the same time, the legal status of digital currency in Russia is also not fully defined, it is not included in the system of civil rights objects. In this regard, we believe that classifying digital currency (including cryptocurrency) as other property in the system of civil rights objects established by Article 128 of the Civil Code of the Russian Federation is the most optimal and correct solution.
