ON THE ISSUE OF THE OBLIGATION TO APPOINT AND CONDUCT A FORENSIC EXAMINATION IN CIVIL CASES CONSIDERED IN THE ORDER OF CLAIM PROCEEDINGS

Abstract (English):
The article is devoted to certain issues concerning the need for the use of expert research and the degree of its evidentiary force in cases considered in the order of claim proceedings. In connection with the existing discussion, the author comes to the conclusion that the judge is not obliged to resort to expert research in each case of consideration of issues in the case, the content of which does not relate to legal knowledge and is not so-called “ordinary knowledge”. According to the author, expert research is often of a certifying nature and contributes to the correct interpretation of the court’s conclusions by persons interested in the lawsuit proceedings.
