BALANCE OF POWER BETWEEN AN ASSISTANT JUDGE AND A COURT CLERK: COMPARATIVE LEGAL ANALYSIS OF THE SITUATION OF PARTICIPANTS WITH UNCERTAIN PROCEDURAL STATUS

Abstract (English):
In the article the theoretical questions concerning problems of establishment and delimitation of procedural status of assistant judge and clerk of a court session are considered. The particulars of the participation of the above-mentioned persons, which are not regulated in Russian criminal procedure legislation, have been identified and analysed in detail (in section II of the Code of Criminal Procedure) articles 244.1 of the Code of Criminal Procedure and article 245 of the Code of Criminal Procedure refer to a situation of uncertainty. The author presents a wide list of competences of each participant, as well as an emphasis on the difference in sphere of activity. It is justified that the assistant judge and the clerk of the court session should be given the procedural status of an independent other participant in criminal proceedings.
