ON THE SUBJECT OF CRIMINAL ENCROACHMENT AND ITS FEATURES IN THE INVESTIGATION OF PENITENTIARY CRIMES

Abstract (English):
The article attempts to analyze modern scientific approaches to the concept of the subject of criminal encroachment. The inconsistency of the forensic separation of the object of criminal encroachment and the subject of criminal encroachment is noted. On the basis of the analysis of empirical data, the author characterizes the subject of criminal encroachment of frequent penitentiary crimes: fraud, bribery, illegal trafficking of narcotic drugs or psychotropic substances, disorganization of the activities of institutions providing isolation from society, causing harm to health etc. The author makes conclusions are formulated about the typical subjects of criminal encroachments in the investigation of penitentiary crimes, as well as about the typical victims of such crimes.
