The article is devoted to the consideration of the main problems arising in the implementation of the rights of minors to residential premises. It is noted that guardianship and guardianship authorities play a special role in this process. The authors examined the legal basis for the activities of the guardianship and guardianship authority, the powers assigned to it, in particular, such authority as a preliminary authorization of the guardianship and guardianship authority to make transactions with real estate owned by wards and the procedure for its implementation; have studied law enforcement practice, scientific literature on the research topic and in some cases express their point of view, in particular, they propose to return the previous version of paragraph 4 of Article 292 of the Civil Code of the Russian Federation. According to the authors, this will allow to eliminate the gap of legal regulation, to pay more attention to the realization of the property rights of a minor to residential premises and to reduce the number of violations of such rights.
