UDK 340.114 Основные идеи. Происхождение и цель права
The article examines the relationship of law, law and will in various paradigms of legal understanding. The essence of the law is revealed as an emanation of the will of various levels subjects: nature, state, society, personality. Analyzing the features of the era of modern digital globalism, the author, along with the existing three types of legal understanding, proposes to recognize a new paradigm – humanistic, considering law as a measure of humanity. The humanization of relations between social subjects also includes the optimization of their relationship to the natural and socio-cultural environment, therefore, the article talks about the need for a new environmental-humanistic type of legal understanding. Law, in contrast to the law, as the will of certain social subjects, is a reflection of their need not so much for freedom and formal equality as for the human need to be human and live in a human society. Therefore, the right is revealed in the article not just as a measure of freedom and justice, but as a measure of humanity.
