ON THE FORMATION AND DEVELOPMENT OF LARGE STRUCTURAL AND FUNCTIONAL UNITS OF THE LEGAL SYSTEM (PHILOSOPHICAL AND LEGAL ESSAY)

Abstract (English):
The article deals with a large and highly signifcant problem in theoretical and practical terms. It is of a debatable nature. For this reason, the article is designated as a philosophical and legal essay. In the author’s opinion, the formation and development of large structural and functional units of the legal system, which forms an element of the legal system, requires special attention. In his opinion, signifcant prospects in the development of law and legal regulation open up if we consider the issue within the framework of the construction «nature – man – society – state». In this case, it becomes possible to conditionally subdivide large legal entities of the legal system into structural and functional divisions related to the nature of the frst, second and third order. Based on this premise, the author considers and solves the question of the relationship between natural law and positive law, gives some classifcations of structural and functional divisions of positive law. The article draws attention to the consequences of virtualization, which is typical for the third world. The article also considers the largely philosophical question of man, society, the state, and the law of the future, which organically fts into the topic of the article, which is maturing in the present, and the roots in the past.
