UDK 347 Гражданское право. Судопроизводство
The article analyzes the main regulatory sources containing a mention of compensation for moral damage. The author comes to the conclusion that for successful compensation for moral damage in a trial, the plaintiff needs a set of knowledge of the relevant institutions of substantive and procedural law, as well as existing judicial practice. It is judicial practice and the judge’s discretion in cases of compensation for moral damage that are of significant importance and are decisive in establishing the amount of moral damage subject to compensation. The analysis shows that judicial practice should be considered as a restraining factor, restraining the discretionary powers and possibilities of the judge in determining the amount of compensation for moral damage in each specific civil case.
