The article examines a relatively new norm of the Russian criminal law – Article 172.4 of the Criminal Code of the Russian Federation (illegal activity for the repayment of overdue debts of individuals). The author considers the signs of the corpus delicti through the prism of the general theory of criminal law. As a result of the study, it was concluded that the independent criminalization of the actions listed in the disposition of Article 172.4 of the Criminal Code of the Russian Federation is justified, however, the validity of the structural placement of the norm in the chapter on crimes in the field of economic activity is questioned. The author argues for the shortcomings of the legal and linguistic structure of the disposition of Article 172.4 of the Criminal Code of the Russian Federation when describing the characteristics of the subject, and also reveals the real and potential problems that arise when qualifying the actions of the perpetrator under Article 172.4 of the Criminal Code and offers options for their resolution.
