IMPROVEMENT OF THE LEGISLATIVE STRUCTURE OF ARTICLE 143 OF THE CRIMINAL CODE OF THE RUSSIAN FEDERATION

Abstract (English):
The issues of the effectiveness of criminal law protection of safe work do not lose their relevance. Problems arising in the practical application of Article 143 of the Criminal Code of the Russian Federation “Violation of labor protection requirements”; inaccurate presentation of the disposition of part 1 of Article 143 of the Criminal Code of the Russian Federation; lack of regulation in the specified norm of potential consequences causing public danger of violation of labor protection requirements; The sizes and types of punishments fixed in the sanctions of the relevant criminal law norms indicate an understatement of the importance of the life and health of workers, which dictates the need to improve the legislative regulation of criminal liability for violations of labor safety requirements. In this regard, and based on a study of the practice of applying Article 143 of the Criminal Code of the Russian Federation, the opinions of legal scholars, taking into account his own vision, the author argues for the need to improve the legislative structure of Article 143 of the Criminal Code of the Russian Federation, proposes and justifies options for such modernization.
