The author considers the general provisions of the legislation on the contract system in the field of application of the norms on liability for non-fulfillment or improper fulfillment of obligations by suppliers (contractors, executors), analyzes the ratio of the concepts of “mandatory” and “essential” terms of the contract, the meaning of the concepts of “nonmonetized”, “monetary” obligations in the context of the application of differentiated penalties to suppliers (contractors, executors), issues of applying a legal penalty.
