The article examines the signs of the objective side of the corpus delicti, which provides for responsibility for the murder of a newborn child by a mother. The author conducted a study of 63 sentences for the murder of a newborn child, handed down by the courts of the Russian Federation from 2010 to 2021 under Art. 106 of the Criminal Code of the Russian Federation. The author comes to the conclusion that the act aimed at killing a newborn is in most cases committed through active action. The need to improve the disposition of the composition of crime “murder of a newborn child by a mother” is revealed, its new version is proposed.
