UDK 343.34 Преступления против общественного порядка и безопасности
The article presents an analysis of the public danger of acts provided for in paragraph “b” of Part 4 of Article 228.1 of the Criminal Code of the Russian Federation. In the course of the study, it was found out that the separate allocation by the legislator of the qualifying attribute “a person using his official position” indicates the recognition by the state of an increased public danger of illegal production, sale or shipment of drugs. The increased public danger of the specified crime may manifest itself in difficult detection, disguise under the performance of a person's official or labor functions, in broader opportunities to avoid criminal prosecution and to counteract the preventive activities of law enforcement agencies. Based on the results of the study, the author draws the conclusion that it is important to comprehensively study the crime associated with the illegal production, sale or shipment of drugs committed by a person using his official position in order to identify its specifics for the subsequent development of effective prevention and counteraction measures.
