Abstract (English):
The article deals with the issues of criminal law evaluation of the note to Article 131 of the Criminal Code of the Russian Federation. It is stated that this note expanded the concept of rape and violent acts of a sexual nature, making it possible to qualify these crimes as an act committed in a non-contact way. It is proved that this legal construction carries elements of legal fiction. The issues of the age of the victim in these crimes and the problems of its establishment are considered. The assessment by the Constitutional Court of the Russian Federation of the note to Article 131 of the Criminal Code of the Russian Federation is given. The difficulties in the qualification of these crimes with an ideal aggregate are analyzed. The author comes to the conclusion that according to Articles 131 and 132 of the Criminal Code of the Russian Federation, only contact forms of violent sexual crimes should be qualified.
