The increasingly fast reformatting of priority areas in prosecutorial activity has brought to the fore the issues of inconsistencies in the regulatory framework which specifies the powers of the prosecutor outside the criminal procedure sphere, as well as unpreparedness of the legislator to promptly respond to emerging challenges. Despite the relatively long-term effect of the powers specified in paragraph 2 of part 2 of Article 37 of the Criminal Procedure Code of the Russian Federation, the mechanism of their implementation has not been sufficiently developed and adequately reflected in the respective legislation. Tis paper attempts to research into the intersectoral nature of the prosecutor’s decision on criminal prosecution as an act of the prosecutor’s response in supervision over the implementation of laws and observance of human and civil rights and freedoms.
