В статье представлен комплексный сравнительно-правовой анализ законодательства различных стран в сфере регулирования особо охраняемых природных территорий (далее – ООПТ). Исследование охватывает международные стандарты охраны окружающей среды и их имплементацию в национальную правовую систему. Автор рассматривает особенности регулирования ООПТ в различных регионах мира, выделяя характерные черты североамериканской, европейской, африканской и азиатской моделей управления природоохранными территориями. Особое внимание уделяется анализу правовых механизмов создания и функционирования ООПТ, включая вопросы финансирования, управления и взаимодействия с местными сообществами. На основе проведенного анализа автор формулирует рекомендации по совершенствованию правового регулирования ООПТ, включая возможность внедрения гибридных моделей управления и развития экотуризма. Исследование демонстрирует, что эффективность системы ООПТ зависит от баланса между государственным контролем и участием местных сообществ, а также от способности законодательства адаптироваться к меняющимся экологическим и социально-экономическим условиям.

The article presents a comprehensive comparative legal analysis of the legislation of various countries in the field of regulation of specially protected natural areas. The study covers international environmental standards and their implementation in national legal systems. The author examines the specifics of the regulation of protected areas in various regions of the world, highlighting the characteristic features of the North American, European, African and Asian models of management of protected areas. Special attention is paid to the analysis of the legal mechanisms for the creation and functioning of protected areas, including issues of financing, management and interaction with local communities. Based on the analysis, the author formulates recommendations for improving the legal regulation of protected areas, including the possibility of introducing hybrid management models and ecotourism development. The study demonstrates that theeffectiveness of a protected area system depends on the balance between state control and the participation of local communities, as well as on the ability of legislation to adapt to changing environmental and socioeconomic conditions
