В статье автором проведен анализ реализации принципа профессионализма, закрепленного в Федеральном законе от 5 апреля 2013 г. № 44-ФЗ «О контрактной системе в сфере закупок товаров, работ, услуг для обеспечения государственных (муниципальных) нужд». Отмечаются проблемы при его реализации в отдельных сферах функционирования контрактной системы. Сделан акцент на необходимости унификации образовательного ценза для сотрудников заказчиков, принимающих участие в функционировании контрактной системы, а также законодательного закрепления штатной контрактной службы (контрактного управляющего) для заказчиков, одновременно убрав возможность функционирования контрактной службы (контрактного управляющего) без создания штатного подразделения.

The article analyzes the implementation of the principle of professionalism enshrined in Federal Law No. 44-FZ of April 5, 2013 “On the contract system in the field of procurement of goods, works, services to meet state (municipal) needs.” It notes the problems in its implementation in certain areas of the functioning of the contract system. Emphasis is placed on the need to unify the educational qualifications for employees of customers who participate in the functioning of the contract system, as well as the legislative consolidation of a full-time contract service (contract manager) for customers, while simultaneously removing the possibility of functioning of a contract service (contract manager) without creating a full-time unit.
