UDK 343.01 Теория. Понятие и основы уголовного права. Право наказывать. Исправление правонарушителя
The article carries out a critical doctrinal and legal analysis of the entire set of criminal law measures applied to minors under current criminal law. It analyzes the statistics of the Judicial Department under the Supreme Court of the Russian Federation over the past 10 years on the practice of appointing compulsory measures of educational influence, criminal punishments, as well as the release of minors from criminal liability and punishment. Current trends in this area are identified, existing problems in the field of legislative regulation of the implementation of criminal law measures against minors are formulated and substantiated, author’s ways of eliminating them are proposed. Attention is paid to the need to adjust the legislative framework and law enforcement practice for the implementation of criminal law measures against minors.
